A jury convicted Billie Gene Helleson, Jr. of the offense of retaliation and assessed punishment at seventy-five years' incarceration in the Institutional Division of the Texas Department of Criminal Justice. See Tex. Penal Code Ann. § 36.06 (Vernon 1994 & Supp. 1999). In three points, Helleson argues that the evidence is factually insufficient to support his conviction, that the trial court erred by refusing to instruct the jury on two lesser included offenses, and that the State made an improper jury argument.
